HushCall™ Terms & Conditions

1. Agreement to These Terms

These Terms & Conditions ("Terms") are a legal agreement between you and Atkins Media, LLC ("HushCall™", "we", "us", or "our") governing your use of the HushCall™ mobile application and related services (the "Service"). By downloading, installing, or using HushCall™, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. What HushCall™ Does

HushCall™ is a personal-safety app. When you're in danger, simply open the app, tap "Start Emergency Alert". The screen shows a 5-second countdown and then automatically triggers the alert. All in complete silence, even while you turn off your screen. When you activate an alert, HushCall™ automatically contacts the emergency contacts you have chosen — placing an automated voice call and, to contacts who have opted in to text messages, sending an SMS containing a live map link to your location. 3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account and use the Service. By using HushCall™ you represent that you meet this requirement and that the information you provide is accurate.

4. Your Responsibilities

• Accurate contacts. You are responsible for entering correct emergency-contact names and phone numbers, and for keeping them up to date.
• People you trust. Only add people you personally know and trust as emergency contacts, and only invite them to opt in with their knowledge.
• Lawful use. You will use the Service only for its intended personal-safety purpose and in compliance with all applicable laws, including laws on recording audio and location.
• Your device & account. You are responsible for your device, keeping your login credentials secure, and any activity under your account.

5. Messaging & Consent

HushCall™ only sends text messages to a contact after that contact has opted in for themselves. You agree not to use the Service to send unwanted messages or to add anyone who has not agreed to be your emergency contact. Recipients can opt out at any time by replying STOP. 6. Acceptable Use

You agree that you will not:

• Trigger false alarms or misuse the emergency features, including using them to harass, prank, or alarm others.
• Use the Service to harm, threaten, stalk, or violate the privacy or rights of any person.
• Reverse-engineer, interfere with, overload, or attempt to gain unauthorized access to the Service or its systems.
• Use the Service for any unlawful purpose or in violation of any applicable law or regulation.

7. Location & Audio

By activating an alert, you consent to HushCall™ collecting and sharing your device's location and, where enabled, short audio recordings and/or live microphone audio with your chosen emergency contacts for the purpose of assisting you. You are responsible for complying with any laws in your jurisdiction regarding the recording of audio.

8. Subscriptions & Payments

• HushCall™ offers an optional premium subscription (HushCall™ Premium) that unlocks alerting all of your saved emergency contacts at once. The free tier alerts your first saved contact.
• Premium is offered as an auto-renewing subscription (for example, US$2.99 per month; pricing may vary by region and is shown at purchase). Payment is charged to your Apple App Store or Google Play account at confirmation of purchase.
• Auto-renewal: the subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Managing & cancelling: you can manage or cancel your subscription anytime in your App Store or Google Play account settings. Removing the app does not cancel the subscription.
• Refunds are handled by Apple or Google according to their policies; we generally cannot issue store-purchase refunds directly.

9. Service Availability & "As Is" Disclaimer

We work hard to keep HushCall™ reliable, but the Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that alerts, calls, texts, location sharing, or audio will always be timely, delivered, accurate, or uninterrupted. The Service depends on factors outside our control — including your device and battery, cellular and internet connectivity, GPS accuracy, and third-party providers such as mobile carriers, Twilio, and cloud services.

10. Limitation of Liability

To the fullest extent permitted by law, Atkins Media, LLC and its owners, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss, injury, or harm arising from your use of — or inability to use — the Service, including any failure or delay of an alert, call, text, or location update. Because HushCall™ is not a substitute for professional emergency services, you use it at your own risk. Where liability cannot be excluded, our total liability is limited to the amount you paid us for the Service in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Atkins Media, LLC from any claims, damages, or expenses arising out of your misuse of the Service, your violation of these Terms, or your violation of any law or the rights of any third party (including any contact you add).

12. Termination

You may stop using HushCall™ and delete your account at any time. We may suspend or terminate your access if you violate these Terms or misuse the Service. Provisions that by their nature should survive termination (such as disclaimers and limitations of liability) will survive.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Effective date" above. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the State in which Atkins Media, LLC is organized, without regard to its conflict-of-laws rules. Any disputes will be resolved in the courts located there, unless applicable law requires otherwise.
